4. Categories of Records Held by Kiddosaurus Preschool
We maintain various records to operate effectively and comply with South African law. Access to these records may be subject to grounds of refusal (e.g., protecting the privacy of other children or staff).
4.1 Records Available Without a Formal Request (Publicly Available)
- Public policies (Privacy Policy, Cookie Policy, POPIA Policy)
- General preschool information, curriculum outlines, and staff profiles on the website
- Marketing and promotional material
4.2 Records That Require a Formal Request
- Company Records: Registration documents, operational licenses (e.g., Department of Social Development registration), health and safety certificates.
- Financial Records: Accounting records, tax returns, banking details, fee structures, and parent invoicing.
- Human Resources: Staff contracts, disciplinary records, payroll information, and vetting/clearance certificates.
- Learner and Parent Records: Enrollment forms, medical information, developmental reports, incident reports, and financial/billing history. (Note: Parents have the right to access their own child's records. Access to other children's records will be strictly denied).
5. How to Request Access to Records
To request access to a record, you must follow these steps:
- Complete the prescribed Form 2 (Request for Access to Record), available on the Information Regulator's website.
- Submit the completed form to our Information Officer via email or hand delivery to the physical address.
- Provide sufficient detail on the form to enable the Information Officer to identify the record requested and the requester.
- Indicate which form of access is required (e.g., hard copy or digital copy).
- Pay the prescribed request fee (if applicable). Details of the fee structure will be provided by the Information Officer upon receipt of the request.
6. Grounds for Refusal of Access
Kiddosaurus Preschool reserves the right to refuse access to records under PAIA to protect:
- The mandatory privacy of a third party who is a natural person (especially minors/children), which would involve the unreasonable disclosure of personal information.
- The commercial information of a third party or the preschool itself.
- Confidential information of third parties if it is protected by an agreement.
- The safety of individuals and the protection of property.
- Records privileged from production in legal proceedings.
7. Prescribed Fees
A requester who seeks access to a record containing personal information about themselves is not required to pay the request fee. Every other requester must pay the prescribed request fee before the request is processed. If the search for and preparation of the record requires more than the prescribed hours, a deposit will be payable. The fee structure is outlined in the PAIA Regulations and can be provided upon request.
